Welcome to Urpod™. These Terms of Service ("Terms") govern your access to and use of the Urpod website and application at urpod.app (the "Service"), operated by DBW Digital Ventures LLC ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms.
Urpod is a personalized AI podcast platform that generates custom audio episodes based on topics, styles, and preferences you define. The Service uses artificial intelligence to research, write, and produce podcast episodes delivered through our web application and RSS feeds compatible with third-party podcast players.
To use the Service, you must create an account by providing a valid email address and password, or by signing in through a supported third-party provider (such as Google). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years of age to create an account; the Service is not directed to children under 13, and we do not knowingly collect personal information from them.
Urpod offers both free and paid subscription plans. Paid plans are billed on a monthly basis and provide additional episode credits, longer episode lengths, and premium features. Specific plan details and pricing are displayed on our website and may be updated from time to time.

Your content: You retain ownership of the topics, prompts, and preferences you provide to the Service. Episodes generated by the Service based on your inputs are licensed to you for personal and commercial use, subject to these Terms.
Our content: The Urpod name, logo, branding, website design, and underlying technology are the property of DBW Digital Ventures LLC and are protected by applicable intellectual property laws.
AI-generated content: Episodes are generated using artificial intelligence and may incorporate information from publicly available sources. While we strive for accuracy through real-time research and verification, we do not guarantee that all content in generated episodes is accurate, complete, or current. You are responsible for verifying any critical information before relying on it. Episodes are produced without human review. Where an episode names a date, figure, price, quote, or person, treat it as unverified until you have checked it against a primary source.
The Service provides RSS feeds that allow you to listen to your episodes in third-party podcast applications (such as Apple Podcasts, Spotify, and others). We are not responsible for the functionality, availability, or policies of third-party platforms. Your use of those platforms is subject to their respective terms of service.
We strive to maintain the Service's availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of material changes that affect their use of the Service.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that generated content will be accurate or suitable for any particular purpose. Without limiting the foregoing, we make no representation that any content is suitable for any financial, legal, medical, or other decision, and Section 8A applies.
Urpod produces AI-generated audio and text for information and entertainment only. Nothing in the Service — including any episode, transcript, show note, summary, suggestion, or the selection or emphasis of any topic — is, or should be relied upon as, financial, investment, tax, accounting, legal, medical, mental-health, nutritional, fitness, insurance, real-estate, or other professional advice, or as a recommendation to buy, sell, or hold any security, currency, digital asset, commodity, or other instrument, or to take or refrain from any action.
Episodes may discuss markets, companies, laws, health topics, sports, and other subjects. They are generated automatically from publicly available sources, may be incomplete, out of date, or wrong, may misattribute or misdate events, and are not reviewed by a licensed professional before delivery. You should not act on anything you hear or read in the Service without independently verifying it and, where appropriate, consulting a qualified professional who knows your circumstances. Personalization based on your topics, preferences, or submissions does not constitute a professional assessment of your circumstances, and using the Service does not establish a professional-client relationship with Urpod or its AI-generated hosts.
Health and wellness content is general information and is not medical or mental-health advice, diagnosis, or treatment. Do not disregard professional advice, delay seeking care, or start, stop, or change any treatment because of this content. Consult a qualified clinician about your circumstances. Do not listen to sleep or meditation audio while driving or operating machinery.
If you are in crisis or need urgent help, contact your local emergency services. The Service is not a crisis, medical, or emergency resource.
By creating an account, and each time you use the Service, you acknowledge and agree that: (1) you have read Section 8A and understand that the Service does not provide professional advice of any kind; (2) you are responsible for your decisions — you will not use the Service as a substitute for qualified professional advice, and you will independently verify material information before acting on it; (3) generated content may contain errors, including statements presented as current that are not; and (4) Release of content-reliance claims:to the extent permitted by applicable law, you release DBW Digital Ventures LLC, its members, officers, employees, contractors, and licensors (the "Urpod Parties") from claims for loss or damage arising from your reliance on information in generated content. This release is limited to such content-reliance claims; other claims arising from your use of the Service are governed by Section 9.
Nothing in these Terms excludes or limits liability for our fraud, gross negligence, or willful misconduct, or any liability or consumer right that applicable law does not permit us to exclude, limit, or waive. The releases and limitations in these Terms apply only to the extent permitted by applicable law.
You agree to indemnify and hold harmless the Urpod Parties from third-party claims, and the reasonable costs of defending them (including reasonable attorneys’ fees), to the extent the claim results from: (a) your material breach of these Terms; (b) your unlawful conduct; (c) infringement or violation of a third party’s rights by material you supply to the Service; or (d) your culpable misuse of the Service or of generated content. This obligation does not apply to the extent a claim results from the Urpod Parties’ own negligence or misconduct, or from an error in generated content that you did not cause. We will give you prompt written notice of any claim for which we seek indemnification; you may participate in the defense with counsel of your choice at your own expense; and neither of us will settle such a claim on terms that impose obligations on the other without that party’s written consent, not to be unreasonably withheld.
To the maximum extent permitted by applicable law, DBW Digital Ventures LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. The limitations in this section apply to claims based on reliance on content in the Service, whether framed in contract, tort (including negligence), statute, or otherwise.
You may terminate your account at any time by contacting us. We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. We may, but are not obligated to, retain your data for a reasonable period after termination.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. Material changes to the provisions on advice, releases, limitation of liability, indemnification, or dispute resolution will be presented for your acceptance the next time you open the Service.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
